In Massachusetts, there are typically two distinctions to be made when discussing child custody:
- Physical custody refers to where the child will actually reside, and during what times. Typically, one parent will be designated as a primary custodian, and one parent becomes the secondary custodian. The schedule of parenting time followed by the secondary custodian is also known as visitation.
- Legal custody refers to which parent has primary decision-making responsibilities in the child's life. Most commonly, parents come to an agreement known as joint legal custody. In this manner, life-altering decisions related to education, religion and medical treatment are made with equal input from both parents.
Clients can count on our understanding of the issues and our knowledge of the law to guide them through the process in the most efficient and cost-effective manner possible. Our lawyers will diligently fight to meld your wishes with the best interests of your child throughout the process.
