In Massachusetts, there are typically two distinctions to be made when discussing child custody:

  • Physical custody refers to where the child will actually reside, and during what times. Typically, one parent will be designated as a primary custodian, and one parent becomes the secondary custodian. The schedule of parenting time followed by the secondary custodian is also known as visitation.
  • Legal custody refers to which parent has primary decision-making responsibilities in the child's life. Most commonly, parents come to an agreement known as joint legal custody. In this manner, life-altering decisions related to education, religion and medical treatment are made with equal input from both parents.
